These Terms and Conditions ("Terms") constitute a legally binding agreement between you and AgentConnect Technologies Private Limited ("RealtorDekho", "we", "us", or "our"), governing your access to and use of the platform available at realtordekho.in and all related services (collectively, the "Platform"). Please read these Terms carefully before using the Platform.

By accessing the Platform, registering a profile, or using any feature, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms are governed by the laws of India and constitute a valid contract under the Indian Contract Act, 1872.

1. Eligibility

You may use the Platform only if:

• You are at least 18 years of age;
• You are a real estate agent or broker holding a valid RERA registration under the Real Estate (Regulation and Development) Act, 2016 ("RERA Act") or applicable state legislation;
• You are legally competent to enter into contracts under the Indian Contract Act, 1872; and
• Your use of the Platform does not violate any applicable law or regulation.

By registering, you represent and warrant that all of the above conditions are satisfied.

2. Platform Description

RealtorDekho is an online intermediary platform that enables RERA-registered real estate brokers to create, manage, and display professional profiles. The Platform provides:

• Broker profile creation and public display;
• Cross-referencing of RERA registration numbers against publicly available government data;
• A BrokerCheck verification link for consumer use;
• A searchable broker directory for consumers and real estate seekers.

RealtorDekho is an intermediary as defined under Section 2(1)(w) of the IT Act, 2000, and operates in accordance with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

4. Broker Registration and Profile

4.1 Registration

To register, you must provide accurate, complete, and current information including your legal name as per RERA records, valid mobile number, and RERA registration number. You are responsible for maintaining the accuracy of your profile information at all times.

4.2 Profile Content

By submitting content (including profile information, photographs, and any other material) to the Platform, you:

• Represent that the content is accurate and not misleading;
• Represent that you own or have the right to share all content submitted;
• Grant RealtorDekho a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute the content on the Platform and in promotional materials;
• Acknowledge that your profile will be publicly accessible and may be indexed by search engines.

4.3 Founding Member Programme

The Founding Member Programme is open to the first 500 qualifying RERA-registered brokers who apply and are approved by RealtorDekho. Founding member status is subject to:

• Successful RERA verification;
• Admin approval at the sole discretion of RealtorDekho;
• Continued compliance with these Terms.

Submission of an application does not guarantee founding member status. RealtorDekho reserves the right to reject any application without assigning reasons. Founding member benefits are valid as long as the Platform operates and the broker remains in good standing.

5. User Obligations

You agree to:

• Provide truthful and accurate information at all times;
• Maintain a valid, active RERA registration during the period your profile is live;
• Update your profile promptly if your RERA status, contact details, or other information changes;
• Use the Platform only for lawful professional purposes;
• Not misrepresent your credentials, qualifications, or past transactions;
• Not use the Platform to make false, misleading, or defamatory statements about other brokers, developers, or consumers.

6. Prohibited Activities

You must not:

• Submit false RERA registration numbers or impersonate another registered broker;
• Upload content that is defamatory, obscene, fraudulent, or in violation of any law;
• Attempt to scrape, reverse-engineer, or extract data from the Platform without written permission;
• Use the Platform to spam, solicit, or conduct unsolicited marketing;
• Interfere with or disrupt Platform security, servers, or networks;
• Create multiple accounts for the same individual or RERA number;
• Engage in any conduct that could harm the reputation of RealtorDekho or other brokers on the Platform;
• Violate any provisions of the RERA Act, IT Act, Consumer Protection Act 2019, or any other applicable law.

7. Intellectual Property

All content on the Platform that is not user-generated — including the brand name "RealtorDekho", "BrokerCheck", logos, design, code, layout, and compilations — is the intellectual property ofAgentConnect Technologies Private Limited and is protected under the Copyright Act, 1957 and applicable trademark law.

You may not reproduce, distribute, modify, or create derivative works from any Platform content without prior written permission. User-generated profile content remains the property of the respective broker, subject to the licence granted in Section 4.2.

8. Platform Availability and Modifications

RealtorDekho is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free access. We reserve the right to:

• Modify, suspend, or discontinue any part of the Platform at any time;
• Remove or modify profiles that violate these Terms;
• Introduce paid features in the future, with adequate notice to existing users.

9. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• RealtorDekho shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform;
• RealtorDekho is not liable for any loss of business, loss of income, or loss of opportunity resulting from reliance on information displayed on the Platform;
• Our aggregate liability to you for any claim shall not exceed the amount paid by you to RealtorDekhoin the 12 months preceding the claim (which, for founding members using the Platform for free, shall be zero);
• We are not responsible for the conduct of brokers registered on the Platform or for transactions between brokers and their clients.

Nothing in these Terms limits liability for fraud, wilful misconduct, or liability that cannot be limited under applicable Indian law.

10. Indemnification

You agree to indemnify, defend, and hold harmless AgentConnect Technologies Private Limited, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to: (a) your use of the Platform; (b) content you submit; (c) your violation of these Terms; or (d) your violation of any third-party rights or applicable law.

11. Refund and Cancellation Policy

The founding member programme is currently offered at no charge. There is no fee, and accordingly no refund is applicable for the current programme.

Should RealtorDekho introduce paid subscription tiers or services in the future:

• Refund terms will be clearly stated at the time of purchase;
• Refund requests must be submitted within 7 days of payment via email to realtordekho@gmail.com;
• Refunds, where applicable, will be processed within 7–14 business days to the original payment method;
• No refund will be issued for services already rendered or where a profile has been published.

12. Termination

RealtorDekho reserves the right to suspend or terminate your profile and access to the Platform, with or without notice, if you:

• Violate these Terms;
• Provide false or misleading information;
• Have your RERA registration suspended, cancelled, or revoked;
• Engage in conduct that is harmful to the Platform, other users, or consumers.

You may request deletion of your profile at any time by contacting realtordekho@gmail.com.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India.

Before initiating legal proceedings, the parties agree to attempt resolution through good-faith negotiation for a period of 30 days.

14. Grievance Redressal

In accordance with the Consumer Protection Act, 2019 and IT Rules 2021, we have designated a Grievance Officer to address complaints:

All complaints must be submitted in writing via the above email address. We will acknowledge receipt within 48 hours and endeavour to resolve complaints within 30 days.

15. Modifications to Terms

We may revise these Terms at any time by posting the updated version on this page with a revised effective date. Material changes will be communicated to registered brokers via WhatsApp or email at least 15 days prior to taking effect. Continued use of the Platform after such notification constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, RERA Disclaimer, and any other policies referenced herein, constitute the entire agreement between you and RealtorDekho with respect to the Platform and supersede all prior or contemporaneous communications and proposals.
