You have strong rights under RERA Section 18. Here's what you can claim:
Interest at the SBI MCLR + 2% rate on the total amount paid to the builder, for the delay period (Dec 2023 to today = ~9 months). The current reference rate is approximately 8.75โ9%. So: if you've paid โน50L, compensation = โน50L ร 9% ร 9/12 = approximately โน3.37L.
If you don't want to continue, you can demand a full refund of all amounts paid, plus interest at the same rate from the date of each payment. This is often the better option if the project looks stuck.
What the builder may argue: Force majeure (COVID extension), approved revised schedule. MahaRERA has been consistent โ COVID extensions ended in 2022, post that delay is on the builder.
